What this website is
This website presents SAYYES! and its references. You can use it without a user account. Merely using this website does not form a contract.
Using this website is free of charge. You incur no costs other than those for your own internet connection.
What SAYYES! does for clients
SAYYES! accompanies coaches, healers and trainers in their digital start. We build your digital presence with you, for example a SAYYES! Page that leads visitors to a goal, such as installing an app or sending you a booking request. We only build in contact channels such as an email address or WhatsApp number if you provide them and want them. You send your enquiry by email to the address given in the imprint. Your email is a non-binding enquiry. We reply with an offer in text form stating the scope of services, the total price, these Terms of Use and, if you are a consumer, the withdrawal notice with the model withdrawal form. The contract is formed when you accept this offer in text form. The contract languages are German and English.
After your order, once your content has arrived, we provide your first version within 24 hours. The 24 hours begin once we have confirmed your order and confirmed to you by email that your content is complete; the first version is the first online state of your page, which we then refine together with you.
As a consumer you have a statutory right of withdrawal; details are in the withdrawal notice included with our offer. If we begin at your express request before the withdrawal period ends, you owe compensation for the services provided up to a withdrawal.
Co-Network
A SAYYES! Profile in the SAYYES! Co-Network for one year, free of charge, is added to the first 50 confirmed orders; no further costs arise for it. The year begins with the start of the Co-Network, not with the order. For the first 50, the order of our order confirmations is decisive; we will notify you of the start of the Co-Network by email. A paid continuation after the year has ended only comes about through a separate, express agreement with you.
Your content and offers of third parties
The content you give us for your page (texts, images, logos, links) comes from you. You are responsible for this content yourself, as well as for your own mandatory disclosures and legal texts. You confirm that you hold the rights to the content you provide.
Contracts for products and services offered on linked websites are concluded exclusively between you and the respective provider. We assume no responsibility for the content, availability and lawfulness of third-party offers. If we become aware of legal infringements, we remove the content or link concerned without delay. Please send notices of this to the email address given in the imprint.
Duties of visitors
You undertake not to misuse this website and not to disrupt its operation.
Usage rights to this website's content
All rights to this website, including its texts, images, layout and name, remain with us or our licensors.
Liability
We are liable without limitation for damages arising from injury to life, body or health, as well as for damages based on intent or gross negligence, and under the Product Liability Act, and where we have given a guarantee or fraudulently concealed a defect.
For the slightly negligent breach of a material contractual obligation, that is, an obligation whose fulfilment is what makes proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage typical for the contract. For the slightly negligent breach of other obligations, our liability is excluded. This applies in particular to content, offers and services of third parties to which this website refers.
Your mandatory statutory rights, in particular your statutory rights in respect of defects and your rights as a consumer, remain unaffected by these Terms of Use.
Data protection
How we handle personal data is set out in our Privacy Policy, which you can reach via the link at the bottom of every page.
Changes to these Terms of Use
We may change these Terms of Use to the extent this is necessary to adapt to changed statutory provisions or supreme-court rulings, or to changes to this website. The version currently in force is always available at this address. For a contract already concluded, the version applicable at the time of conclusion continues to apply.
Governing law and jurisdiction
These Terms of Use and any disputes or claims arising out of or in connection with them are governed by the law of England and Wales, excluding conflict-of-law rules. For consumers, this applies only to the extent it does not deprive them of the protection afforded by mandatory provisions of the law of their habitual residence.
If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the courts of England and Wales have jurisdiction over disputes arising from these Terms of Use. If you are a consumer, you may sue us at your place of residence; we may sue you only at your place of residence.
International use
This website is accessible internationally. The laws of the country in which you are located may differ from those of the United Kingdom. If you use this website outside the United Kingdom, you are responsible for complying with the laws applicable in your jurisdiction.
Final provisions
Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions remains unaffected; the statutory provisions take the place of the invalid provision.
These Terms of Use are provided in several languages. The German version is authoritative; the other language versions serve for your information only.
Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Sec. 36 VSBG).
